Terms of Service

1. Acceptance of Terms

By accessing or using Mutasib ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. Mutasib is owned and operated by Mutasib ("we", "us").

2. Description of Service

Mutasib is a cloud-based shop management and point-of-sale (POS) platform that helps shop owners manage inventory, process sales, track revenue, generate reports, and connect with customers. The Service is offered on a subscription basis with Free, Starter ($9/month), Pro ($19/month), and Business ($39/month) plans. All prices are in US Dollars.

3. Account Registration

You must be at least 18 years old to create an account. You agree to provide accurate information, maintain account security, and accept responsibility for all activity under your account. We reserve the right to refuse service or terminate accounts at our sole discretion.

4. Subscription & Billing

Paid plans are billed monthly. By selecting a paid plan, you authorize us to charge the applicable fees. You may cancel at any time — cancellation takes effect at the end of the current billing period, and you retain access to paid features until then. For refund eligibility, see Section 4.1 below.

For users outside Egypt, all payments are processed through Lemon Squeezy, which acts as the Merchant of Record for your purchases. This means Lemon Squeezy, not Mutasib, is your contracting party for payment processing, billing, sales tax/VAT, and refunds. Your payments are also subject to Lemon Squeezy's own terms of service.

For users in Egypt only, Paymob is presented as a payment option at checkout; this option is not shown to users outside Egypt. Paymob is a licensed payment service provider operating in Egypt. Unlike Lemon Squeezy, Paymob does not act as Merchant of Record — Mutasib remains your contracting party for your subscription, while Paymob securely handles the underlying payment transaction. Payment processing through Paymob is subject to Paymob's own terms of service in addition to these Terms.

We do not store your credit card details or any other sensitive payment data on our servers or in our databases, whether for Lemon Squeezy or Paymob transactions. All payment data is processed directly and securely by the relevant payment provider (Lemon Squeezy or Paymob) and never passes through or is stored in our systems.

4.1 Refund Policy

We offer a 7-day free trial to allow you to fully evaluate Mutasib before making a financial commitment. Because you have the opportunity to test our platform without any upfront charge, all subscription payments—including initial purchases and automatic monthly renewals—are considered final and non-refundable by Mutasib.

Cancellations

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period and you keep paid access until then. Cancelled or partially used periods are not refunded or prorated.

Billing Errors

If you believe you were charged due to a system error, contact us within 7 days so we can investigate and correct it. [email protected].

Merchant of Record (Outside Egypt)

For users outside Egypt, Lemon Squeezy is the Merchant of Record for your subscription — your contracting party for payment processing, billing, taxes, and refunds. Refund requests in these regions must go through Lemon Squeezy: lemonsqueezy.com.

Users in Egypt

For users in Egypt, Paymob processes the payment but Mutasib remains the Merchant of Record. Refund requests go through Mutasib support: [email protected].

5. Acceptable Use & Prohibited Products

You agree not to: use the Service for illegal purposes, upload malware, disrupt the Service or its infrastructure, attempt unauthorized access, harass others, or resell the Service without written permission.

You represent and warrant that any content you upload or enter into the Service (including product images, descriptions, brand names, and logos) does not infringe any third party's intellectual property rights. You are solely responsible for ensuring you hold the necessary rights or licenses for any content you upload.

6. Intellectual Property

The Mutasib name, logo, design, software, and code are our exclusive property. You retain ownership of your shop data, product listings, and sales records. By using the Service, you grant us a license to host and process your data solely for providing the Service.

7. Third-Party Services

The Service integrates with third-party providers including payment processors (Lemon Squeezy for most regions, and Paymob for users in Egypt), email services, AI services, and cloud storage. We are not responsible for third-party availability or accuracy. Use of these services is subject to their respective terms.

8. Indemnification

You agree to indemnify, defend, and hold harmless Mutasib, its employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) any content you upload or display through the Service, including prohibited products or content that infringes intellectual property rights; (c) your violation of these Terms; or (d) your violation of any third-party right.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. Mutasib shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid us in the twelve months preceding any claim.

10. Dispute Resolution

In the event of any dispute relating to these Terms or the Service, the parties agree to first attempt to resolve the dispute informally through direct communication within 30 days of written notice of the dispute. If the dispute is not resolved informally, both parties agree to submit it to binding arbitration rather than litigate in court.

11. Termination

We may suspend or terminate your account at any time, with or without notice, if you violate these Terms, engage in fraud, abuse, or illegal activity, or at our sole discretion to protect the Service. You may delete your own account at any time from Settings; deletion ends your access immediately. How long data is retained after termination is described in our Privacy Policy.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notice. Continued use after changes constitutes acceptance.
